MEMBERS' CODE OF CONDUCT - DECLARATIONS OF INTEREST

Members of the Panel were asked to declare any disclosable pecuniary and non-pecuniary interests in connection with any application on the agenda and state the nature of the interest.

 

No such declarations were made.

PRIVATE HIRE VEHCILE LICENCE APPLICATION pdf icon PDF 89 KB

Minutes:

The Managing Director for Delivery reported upon an application to re-license a Vauxhall Vectra, registration number FH07 TNE, beyond the normal over-age date for a licensed private hire vehicle.  The date of first registration of the vehicle was 10 July 2007.  It had been licensed as a private hire vehicle since 8 June 2016 and the current licence was due to expire on 7 June 2017; however it had been extended to 10 July 2017, the date the vehicle reached ten years old.  The vehicle had passed the compliance test necessary for a licence to be issued.

 

The owner of the vehicle was present at the meeting with his vehicle, which Members of the Panel inspected.

 

RESOLVED:

That the application to re-license the Vauxhall Vectra, registration number FH07 TNE, be granted for a further six months.

To consider any other business that the Chair accepts as being urgent.

EXEMPT INFORMATION - EXCLUSION OF THE PRESS AND PUBLIC

The following items contain exempt information.

 

RECOMMENDATION:  That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information as defined by the relevant paragraphs of Part I of Schedule 12A (as amended) to that Act. The Public Interest test has been applied and favours exclusion.

HACKNEY CARRIAGE DRIVER LICENCE (SGR)

Minutes:

The Managing Director for Delivery submitted a report for Members to consider whether Mr SGR should continue to hold a Hackney Carriage Driver Licence.  Mr SGR attended the meeting and made representations.

 

Members considered the representations made by Mr SGR regarding his conviction. 

 

Members gave due consideration to Mr SGR’s representations and exercised their right to consider each case on its individual merits in light of the representations made.

 

RESOLVED:

That Mr SGR be given a verbal warning but be allowed to continue to hold his licence.

PRIVATE HIRE DRIVER LICENCE - APPLICATION (RJL)

Minutes:

The Managing Director for Delivery reported upon an application received by Mr RJL for the grant of a Private Hire Driver Licence.  Mr RJL attended the meeting and made representations in respect of his application for a Private Hire Driver Licence. 

 

Mr RJL responded to questions from the Panel.

 

Members considered the representations made by Mr RJL regarding the nature of his convictions.  Members had due regard to their Policy in considering this matter.

 

Members applied the principle of proportionality enshrined within the Human Rights Act 1998 and considered that the protection and safety of members of the public was of paramount concern.

 

RESOLVED:

That Mr RJL’s application for a Private Hire Driver Licence be refused.

HACKNEY CARRIAGE VEHICLE LICENCE APPLICATION pdf icon PDF 95 KB

Minutes:

The Managing Director for Delivery reported upon an application to license an LTI TXII, registration number DG02 MGV, as a Hackney Carriage Vehicle.  The vehicle was licensed as a Hackney Carriage Vehicle until 6 April 2017, when the then proprietor changed his vehicle to one that is six years old in compliance with the Council’s Policy.  The vehicle had passed the compliance test necessary for a licence to be issued.

 

The owner of the vehicle, and his representative, were present at the meeting, with his vehicle, which Members of the Panel inspected.  The owner responded to questions from Members of the Panel.

 

Members considered the representations made and decided to act outside of their Policy on this occasion.

 

RESOLVED (3:1):

That the application to license the LTI TXII, registration number DG02 MGV, as a Hackney Carriage Vehicle, be granted.
