That, in the absence of the Chair, the Panel be requested to appoint a Chair for this meeting.

Resolved: That in the absence of the Chair, Councillor P Stuart be elected as Chair for this meeting.

MEMBERS' CODE OF CONDUCT - DECLARATIONS OF INTEREST

Members of the Panel are asked to declare any disclosable pecuniary and non pecuniary interests, in connection with any application on the agenda and state the nature of the interest.

Members of the Panel were asked to declare any disclosable pecuniary and non-pecuniary interests in connection with any application on the agenda and state the nature of the interest.

 

No such declarations were made.

PRIVATE HIRE VEHICLE LICENCE APPLICATION - FORD MONDEO, REGISTRATION NUMBER YR07 FYX pdf icon PDF 90 KB

Minutes:

The Managing Director for Delivery reported upon an application to re-license a Ford Mondeo, Registration Number YR07 FYX, beyond the normal over-age date for a licensed private hire vehicle. The vehicle had been licensed as a private hire vehicle since 10 August 2011 and the current licence was due to expire on 9 August 2017, however it had been extended to the date of this meeting. The vehicle had been examined at one of the Council’s authorised testing stations and the pass certificate was available for Members.

 

The owner of the vehicle was present at the meeting with his vehicle which members of the Panel inspected.

 

Resolved - That the application to re-licence the Ford Mondeo, Registration Number YR07 FYX be refused.

PRIVATE HIRE VEHICLE LICENCE APPLICATION - TOYOTA AVENSIS, REGISTRATION NUMBER NM06 ZDN pdf icon PDF 90 KB

Minutes:

The Managing Director for Delivery reported upon an application to re-license a Toyota Avensis, Registration Number NM06 ZDN, beyond the normal over-age date for a licensed private hire vehicle. The vehicle had been licensed as a private hire vehicle since 21 May 2014 and the current licence had been due to expire on 10 August 2017 however it had been extended to the date of the meeting. The vehicle had been examined at one of the Council’s authorised testing stations and the pass certificate was available for Members.

 

The owner of the vehicle was present at the meeting with his vehicle which members of the Panel inspected.

 

Resolved- That the application to re-licence the Toyota Avensis, Registration Number NM06 ZDN be granted for a further 6 months.

APPLICATION TO LICENSE A FORD TOURNEO ECLIPSE AS A PRIVATE HIRE VEHICLE pdf icon PDF 103 KB

Minutes:

The Managing Director for Delivery reported upon an application to License a Ford Tourneo Eclipse as a Private Hire Vehicle.

The Applicant advises that the vehicle is currently licensed in a number of local authorities.

The Applicant had presented the Panel with a letter answering the question raised by the previous Panel regarding safety and structural integrity.

Mr D Chadwick answered questions from the Panel on the Structural Integrity Study report he had conducted.

 

Resolved - That the application to licence the Ford Tourneo Eclipse, as a Private Hire Vehicle be granted for vehicles with no tables and a Condition Notice that every vehicle must have passed an IVA M1 Category Test.

EXEMPT INFORMATION - EXCLUSION OF THE PRESS AND PUBLIC

The following items contain exempt information.

 

RECOMMENDATION:  That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information as defined by the relevant paragraphs of Part I of Schedule 12A (as amended) to that Act. The Public Interest test has been applied and favours exclusion.

PRIVATE HIRE DRIVER LICENCE - APPLICATION (GJD)

Minutes:

The Managing Director for Delivery reported upon an application to consider whether Mr GJD should be granted a Private Hire Driver Licence.

 

Mr GJD attended the meeting.

 

Mr GJD responded to questions from the Panel and Mr K Abraham, Legal Advisor.

 

Members had due regard to their Policy, however, after careful consideration of the representations made, exercised their right to consider each case on its own merits and on this occasion Members were persuaded to act outside of their Policy in determining their application.

 

Resolved- That Mr GJD’s application for a Licence be granted for 3 years.

The Managing Director for Delivery reported upon an application to consider whether Mr SSM should be granted a Private Hire Driver Licence.

 

Mr SSM attended the meeting.

 

Mr SSM responded to questions from the Panel and Mr K Abraham, Legal Advisor.

 

Members had due regard to their Policy, however, after careful consideration of the representations made, exercised their right to consider each case on its own merits and on this occasion Members were persuaded to act outside of their Policy in determining their application.

 

Resolved- That Mr SSM’s application for a Licence be granted for 3 years.

PRIVATE HIRE DRIVER LICENCE - APPLICATION (MH)

Minutes:

The Managing Director for Delivery reported upon an application to consider whether Mr MH should be granted a Private Hire Driver Licence.

 

Mr MH attended the meeting.

 

Mr MH responded to questions from the Panel and Mr K Abraham, Legal Advisor.

 

Members had due regard to their Policy, however, after careful consideration of the representations made, exercised their right to consider each case on its own merits and on this occasion Members could see no reason to act outside  of their Policy in determining their application due to the number and nature of the convictions.

 

Resolved- That Mr MH’s application for a Licence be refused.
