MEMBERS' CODE OF CONDUCT - DECLARATIONS OF INTEREST

Members of the Committee are asked to declare any disclosable pecuniary and non pecuniary interests, in connection with any application on the agenda and state the nature of the interest.

Members were asked to declare any disclosable pecuniary and non pecuniary interests, in connection with any application on the agenda and state the nature of the interest.

 

Councillor S Niblock declared a non pecuniary personal interest in Item 3 - Designated Public Places Order - New Ferry (minute 32 refers) by virtue of being Ward Councillor and having presented the petition to Council.

 

Councillor I Williams declared a non pecuniary personal interest in Item 3 - Designated Public Places Order - New Ferry (minute 32 refers) by virtue of being Ward Councillor.

 

The Chair declared a non pecuniary personal interest in Item 4 - Wirral Award 2012 (minute 33 refers) by virtue of being a Member of the Wirral Award Working Party and indicated that he would not take part in the deliberations in respect of this item.

 

Councillor J Hale declared a non pecuniary personal interest in Item 4 - Wirral Award 2012 (minute 33 refers) by virtue of having nominated a candidate to receive the Wirral Award and indicated that he would not take part in the deliberations in respect of this item.

  Councillor S Niblock declared a personal interest in this matter by virtue of being Ward Councillor and having presented the petition to the Council.

 

  Councillor I Williams declared a personal interest in this matter by virtue of being Ward Councillor.

 

The Acting Director of Law, HR and Asset Management sought the views of Members on the designation of an area within New Ferry under the Criminal Justice and Police Act 2001 as being subject to a Designated Public Places Order.

 

The Licensing Manager outlined the report and advised that there was a typographical error regarding one of the streets contained within the report that should have read Olinda Street rather than Olinder Street.  She informed Members of the cost implications and advised Members that they were to consider whether officers should undertake the required consultation and advertising procedure for introducing a Designated Public Places Order in respect of the area identified on the map attached to the report.

 

The Licensing Manager responded to questions from Members of the Committee.

 

Sergeant Jenkins, Licensing Sergeant, Merseyside Police, attended the meeting and reported upon the problems regarding anti-social behaviour and alcohol within the area and advised that the evidence showed a clear link between the two.

 

Councillor Niblock urged Members of the Committee to endorse the consultation process in respect of a Designated Public Places Order being introduced in New Ferry and commented upon the area to be designated.

 

Councillor Salter endorsed the views of Councillor Niblock.

 

It was moved by the Chair and seconded by Councillor J Salter that -

 

“Officers undertake the required consultation and advertising procedure for introducing a Designated Public Places Order in respect of New Ferry and that the results of the consultation be reported to a future meeting of this Committee.”

 

Resolved (10:0) -

 

(1)  That the consultation and advertising procedure for introducing a Designated Public Places Order in respect of New Ferry be undertaken.

 

(2)  That the results of the consultation be reported to a future meeting of the Licensing, Health and Safety and General Purposes Committee.

  Councillor W J Davies declared a personal interest in this matter by virtue of being a Member of the Wirral Award Working Party and took no part in the deliberations.

 

  Councillor J Hale declared a personal interest in this matter by virtue of having nominated a candidate for the Wirral Award and took no part in the deliberations.

 

It was moved by Councillor C Povall and seconded by Councillor J Salter that -

 

“The public be excluded from the meeting during consideration of this matter on the grounds that disclosure may involve providing personal information about individuals.”

 

Resolved -  That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of this item of business on the grounds that it involves the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A (as amended) to that Act. The Public Interest test had been applied and favoured exclusion.

 

The Acting Director of Law, HR and Asset Management presented for consideration the recommendations of the Wirral Award Working Party held on 28 November 2012.  The Wirral Award was intended to confer civic recognition upon individuals or organisations resident or located in Wirral for an outstanding achievement within the previous twelve months, or for distinguished service to the Borough over a period of twenty years or more.

 

It was reported that once nominations were agreed, a presentation ceremony and formal dinner would be held.

 

The recommendations of the Wirral Award Working Party were provided with the report and each nominee was discussed by Members of the Committee.

 

Resolved - That the Wirral Award 2012 be conferred on the following recipients recommended by the Wirral Award Working Party, and the suggested arrangements be agreed:

  • John Earp
  • Bernie Gallagher
  • Jackie Hall
  • Richard Longster
