MEMBERS' CODE OF CONDUCT - DECLARATIONS OF INTEREST

Members of the Panel are asked to declare any disclosable pecuniary and non pecuniary interests, in connection with any application on the agenda and state the nature of the interest.

Members of the Panel were asked to declare any disclosable pecuniary and non-pecuniary interests, in connection with any application on the agenda and state the nature of the interest.

 

No such declarations were made.

34.

EXEMPT INFORMATION - EXCLUSION OF THE PRESS AND PUBLIC

Minutes:

Resolved - That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information as defined by the relevant paragraphs of Part I of Schedule 12A (as amended) to that Act.

 

35.

PRIVATE HIRE DRIVER LICENCE (AX)

Minutes:

The Corporate Director for Business Management introduced a report to consider an application received from Mr AX for the grant of a Private Hire Driver Licence.  Mr AX attended the meeting, represented by his representatives, and made representations in respect of his application. 

 

Members questioned Mr AX in respect of his application.

 

Members gave due consideration to the representations made by Mr AX and exercised their right to consider each case on its individual merits in light of the representations made.

 

Resolved – That Mr AX’s application for the grant of a Private Hire Driver Licence be granted.

36.

PRIVATE HIRE AND HACKNEY CARRIAGE DRIVER LICENCES (SS)

Minutes:

The Corporate Director for Business Management introduced a report to consider whether Mr SS should continue to hold a Private Hire and a Hackney Carriage Driver Licence.

 

Mr SS attended the meeting and made representations regarding his convictions.

 

Members considered Mr SS’ representations and exercised their right to consider each case on its individual merits in light of the representations made. 

 

Resolved: That:

 

(1)  Mr SS be allowed to continue to hold a Private Hire and a Hackney Carriage Driver Licence.

 

(2)  Mr SS must undertake a Driver Awareness Course no later than 16 August 2019.

 

(3)  Mr SS be issued with a written warning from Members of the Licensing Panel as to his future conduct.

 

(4)  Mr SS be referred back to the Licensing Panel, should he not undertake the Driver Awareness Course within the time limit.

37.

PRIVATE HIRE DRIVER LICENCE (CJE)

Minutes:

The Corporate Director for Business Management introduced a report to consider whether Mr CJE should continue to hold a Private Hire Driver Licence.

 

Mr CJE attended the meeting, made representations regarding his convictions and answered questions from Members. 

 

Members gave due consideration to Mr CJE’s representations and exercised their right to consider each case on its individual merits in light of the representations made.

 

Resolved:  That:

 

(1)  Mr CJE be allowed to continue to hold a Private Hire Driver Licence.

 

(2)  Mr CJE be issued with a written warning from Members of the Licensing Panel as to his future conduct.

 

(3)  Mr CJE must undertake a Driver Awareness Course no later than 16 August 2019.

 

(4)  Mr CJE be referred back to the Licensing Panel, should he not undertake the Driver Awareness Course within the time limit.

38.

PRIVATE HIRE DRIVER LICENCE (SdeJNJ)

Minutes:

The Corporate Director for Business Management reported upon an application received from Mr SdeJNJ for the grant of a Private Hire Driver Licence.

 

Mr SdeJNJ did not attend the meeting.

 

Resolved – That Mr SdeJNJ be advised to attend a future meeting of the Licensing Panel should he wish to continue with his application.

PRIVATE HIRE DRIVER LICENCE (MSU)

Minutes:

The Corporate Director for Business Management submitted a report for Members to consider an application received from Mr MSU for the grant of a Private Hire Driver Licence.  Mr MSU attended the meeting and made representations in respect of his application.

 

Members considered the representations made by Mr MSU regarding the circumstances and nature of his convictions as well as other material information relevant to his application.  Members had regard to their Policy, and on this occasion were not persuaded to act outside their Policy.

 

In determining the matter Members also gave serious consideration to their overriding responsibility in respect of the protection and safety of the public. 

 

Resolved – That Mr MSU’s application for the grant of a Private Hire Driver Licence be refused.

40.

PRIVATE HIRE DRIVER LICENCE (COJ)

Minutes:

The Corporate Director for Business Management submitted a report to consider an application received from Mr COJ for the grant of a Private Hire Driver Licence.  Mr COJ attended the meeting and made representations in respect of his application.

 

Members considered the representations made by Mr COJ regarding the circumstances and nature of his convictions as well as other material information relevant to his application. 

 

Members had regard to their Policy, however, after careful consideration of the representations made, exercised their right to consider each case on its own merits and on this occasion, Members were persuaded to act outside of their Policy in determining this application.

 

Resolved – That Mr COJ’s application for the grant of a Private Hire Driver Licence be approved.

 

At this point, Councillor Greaney left the meeting.

 

 

41.

HACKNEY CARRIAGE DRIVER LICENCE APPLICATION (LH)

Minutes:

The Corporate Director for Business Management reported upon an application received by Mr LH for the grant of a Hackney Carriage Driver Licence. 

 

Mr LH attended the meeting and made representations in respect of his application. 

 

Members considered the representations made by Mr LH regarding the circumstances and nature of his convictions as well as other material information relevant to his application. 

 

Members had regard to their Policy, however, after careful consideration of the representations made, exercised their right to consider each case on its own merits and on this occasion, Members were persuaded to act outside of their Policy in determining this application.

 

Resolved – That Mr LH’s application for the grant of a Hackney Carriage Driver Licence be approved.
