Minutes:

The Corporate Director for Delivery Services submitted the above application for consideration.

 

The Committee were advised that an additional condition had been applied, as follows:

 

“A scheme for the provision of bat boxes on site to mitigate for the potential loss of bat roosts shall be submitted to and agreed in writing with the Local Planning Authority before development commences. The bat boxes shall be installed before the first occupation of the building.”

 

On a motion proposed by Councillor K Hodson and seconded by Councillor D Elderton it was proposed that the application be refused for the following reasons:

 

“ The Development to the next property would be visually overbearing, dominant and an overdevelopment. The application is not of a scale that related well to surrounding property in particular with respect to the existing densities and form of development. It would result in a detrimental change in the character of the area. “

 

The Motion was put and lost ( 4:8)

 

On a motion by Councillor S Foulkes and seconded by Councillor G Davies it was:

 

Resolved (8:4) That the application be approved subject to additional condition and the following conditions:

 

Thedevelopmentherebypermittedshallbebegunbeforetheexpirationof3 yearsfromthedateof thispermission.

 

Thedevelopmentherebypermittedshallbecarriedoutinaccordancewiththeapprovedplans receivedbythelocalplanningauthorityon19February2018andlistedasfollows:Project No:17/BRIM Drawing No: PLAN/02 (datedJan'18); Project No:17/BRIM Drawing No: PLAN/03 (dated Jan'18);ProjectNo:17/BRIMDrawingNo:PLAN/04(datedJan'18);ProjectNo:17/BRIMDrawing No:PLAN/05(datedJan'18);ProjectNo:17/BRIMDrawingNo:PLAN/06(datedJan'18)& Project No:17/BRIM Drawing No: PLAN/07 (datedJan'18)

 

Beforepreparationofanygroundworksandfoundationsonsiteforthedevelopmenthereby approved,a scheme of hard and soft landscaping shall be submitted to andapproved in writing bythe LocalPlanningAuthorityandtheseworksshallbecarriedoutinaccordancewiththeapproved details.Thesedetailsshallincludetheproposedboundarytreatments,proposedfinishedlevelsand contours,hardsurfacefinishes(includingsamples),detailsofanyretainingwalls,steps,railings, walls,gatesorothersupportingstructures.Theinformationshallalsoincludeindicationsofall existingtreesandhedgerowsontheland,includingthoseto beretained,togetherwithmeasuresfor theirprotectionwhich shallcomplyin fullwithBS5837:2012TreesinRelationto Design,Demolition& Construction- Recommendations,inthecourseofthedevelopment,togetherwitha schemeforthe subsequent maintenanceofanytrees,shrubs andhedges  toberetainedonthesiteandany proposedto beplanted as partofthe approved landscapingscheme.

 

Beforeanyconstruction commences, samplesofthe materialsto be usedin theexternal construction of this development,includingfacingbrickand rooftiles,shallbe submittedtoandapprovedinwriting by theLocalPlanningAuthority.Theapprovedmaterialsshallthenbeusedintheconstructionofthe development.

 

No development shall take placeuntildetailsofsecurecoveredcycleparkingand/or storagefacilitieshavebeensubmittedto andapprovedinwritingbytheLocalPlanningAuthority. Thesefacilitiesshallbeprovidedinaccordancewiththeapproveddetailsandmadeavailableforuse priortothefirstuseofthedevelopmentherebypermittedandshallberetainedforuseatalltimes thereafter.

 

Prior to the first occupation of the dwellings, arrangementsforthestorageand disposalofrefuse,includingrecyclingfacilities,andvehiclesaccessthereto,shallbemadewithinthe curtilageofthesiteinaccordancewithdetailsto besubmittedto andagreedinwritingbytheLocal PlanningAuthority.Theapproveddetailsshallbeimplementedinfullunlessotherwiseagreedin writingwiththeLocal Planning Authority.

 

Priorto the occupation of thedevelopment herebyapproved,allside windowsonthesouthwest elevationadjacentto 14Brimstage Road shall be obscurelyglazedandnon-opening up to aheight of 1.7mfromthefloorleveloftheroomtheyserve.The windows shall be retained as suchthereafter.

 

Priortotheoccupationofthe developmentherebyapproved, detailsofa privacyscreento the north eastern sideofthe firstfloor  balconytoapartment5 andthesouthwesternside of thefirstfloor balconyto apartment 4, shallbesubmittedto and agreed inwritingwiththeLocal Planning Authority. The screens shallbeput inplacebefore flatsare brought intouseandretainedas such thereafter.

 

Before anyequipment,machineryormaterialsare brought ontosite,a 1metrehighfenceorother barrierasagreed inwritingwiththeLocal Planning Authority,shall be erectedaround the outerlimitofthecrown spread of alltrees,hedgesorwoodlands shownto beretainedon the approvedplan.Such fencingshallbemaintained in a satisfactorymanneruntilthe development is completed.During the periodofconstruction, no materialshall be stored,fires started ortrenchesdug withintheseenclosed areaswithouttheprior consent in writing of theLocal Planning Authority.
