Reason for urgency: Wirral has adhered to the Council’s contract procedure rules. There are 2 factors that mean this decision now needs to be placed urgently and cannot await the usual 28 days notification of the forward plan. Firstly the Council is working to a deadline of April 2026 to meet both new statutory requirements and a contractual variation with its contractor Biffa. Given that there is a change in legislation regarding collection of food waste, many other local authorities are preparing to order new vehicles. If the Council does not purchase the vehicles, it will lose the vehicle price/build slots etc and that the vehicles will not be ready in time for the commencement of the contract variation in April 2026. Failure to provide the vehicles at the commencement of the contract variation with Biffa could result in contract payments without contract service.
