Resolved - That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A to that Act.

Minute 6 - GRIEVANCE APPEAL

Further to minute 5 (5/11/03), the Sub-Committee convened to consider the grievance appeal of an employee in the Education and Cultural Services Department. The appellant was represented by Mr M Cashman of the TGWU.
  Minute Decision :
Resolved -

(1) That, having considered carefully all the evidence, the Appeals Sub-Committee upholds the grievance of the appellant on the grounds that he had been placed at an unfair disadvantage by an unfair, opaque and inefficient training selection process.

(2) The Appeals Sub-Committee recommends to the Director of Education and Cultural Services that:

(i) He take immediate steps to offer the appellant the training which he had been denied in 2002.
(ii) He uses reasonable endeavours to redeploy the appellant to another suitable post within his department.
(iii) He ensures that the officers involved in the selection process for training in 2002 should themselves undergo appropriate training in employment procedures which comply with the Council's policy on equality and diversity and which enable the Council to comply with its statutory obligations in this field.
