20076607 - 'Heatherstones', 92 Oldfield Road, Heswall - Remodelling of property to two-storey dwelling with landscaping, terrace and swimming pool and relocation of driveway - Councillor Johnson declared a prejudicial interest in the above application by virtue of owning fields which abut the application site and left the meeting while it was considered.

20076426 - Within the boundary of Beechwood Drive, Fender Way and Fifth Avenue, Beechwood - Improvements to hard and soft landscaping for Beechwood Commercial Centre. Most of the improvements based around tree planting - Councillor Cocker declared a prejudicial interst in this application by virtue of being a Board Member on the Beechwood and Ballantyne Community Housing Association. He vacated the Chair and left the meeting while it was considered.

Minute Decision :

Resolved - That the application be approved subject to the following conditions:

1 Approval of the detail of the siting, design and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called 'the reserved matters') shall be obtained from the Local Planning Authority in writing before the development is commenced.

2 Application for approval of reserved matters must be made to the Local Planning Authority before the expiration of three years from the date of this permission.

3 The development hereby permitted shall be begun either before the expiration of three years from the date of this permission or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later.

4 No development shall take place until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. Development shall be carried out in accordance with the approved details.

5 Development shall not commence until a scheme for the provision of cycle parking has been submitted to and agreed in writing by the local planning authority. The cycle parking facility shall be erected in accordance with the approved details prior to the occupation of the development hereby approved and retained as such thereafter.

6 Any further submission of details shall include floor levels of the dwelling(s) and relationship to the level of the highway.

7 Details of land / surface water drainage shall be submitted to and approved in writing by the local planning authority prior to the commencement of development. The drainage scheme shall be carried out in accordance with the approved details prior to the development hereby approved being brought into use.

8 Details of any security or floodlighting shall be submitted to and agreed in writing with the Local Planning Authority before any such lighting is brought into use.

9 As part of the submission of reserved matters finished floor levels shall be provided together with proposed levels within the site and a survey of existing site levels.

10 No development shall be commenced until full details of soft and hard landscaping have been submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall detail the locations, species and heights of all existing and proposed trees, shrubs and hedge planting and all existing and proposed grassed and hard surfaced areas and any other natural or proposed features.

11 Any trees or shrubs removed, dying, being severely damaged or becoming seriously diseased within five years from the completion of the scheme shall be replaced by trees or shrubs of a similar size and species to those originally required to be planted unless otherwise approved in writing by the Local Planning Authority.

12 All hard and soft landscape works shall be carried out in accordance with the approved details as set out in Condition 12. The works shall be carried out:

- Prior to the occupation of any part of the development;

13 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification) no gates, fences, or walls shall be erected within the curtilage of any dwelling house forward of any wall of that dwelling house which fronts on to a road

14 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order with or without modification) the enlargement, of the dwelling(s) or any addition to the roof or the erection or construction of a porch shall not be carried out .

15 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order with or without modification) no development shall be carried out if it would consist of or include the cladding of any part of the exterior of the dwelling (s) with stone, artificial stone, timber, plastic or tiles.

16 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order with or without modification) the erection of any building within the curtilage of the dwelling(s) shall not be carried out.

17 Any subsequent reserved matters application submitted to the Local Planning Authority must comply and be in accordance with all aspects of the content of the accompanying design code to this application hereby approved.

18 Notwithstanding the details indicated on drawing number 690/3.200, details of the proposed highway layout fronting 71 to 89 Fountain Street are to be submitted and approved in writing prior to commencement of construction. Upon receipt of written approval, all details approved as a part of this condition must be implemented and maintained in full thereafter.

Resolved - That the application be approved subject to the following conditions and also to a Section 106 Legal Agreement:

1 The development to which this permission relates must be begun not later than the expiration of three years from the date of this permission.

2 No development shall take place until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. Development shall be carried out in accordance with the approved details.

3 No development shall be commenced until full details of soft and hard landscaping have been submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall detail the locations, species and heights of all existing and proposed trees, shrubs and hedge planting and all existing and proposed grassed and hard surfaced areas and any other natural or proposed features.

7 A Travel Plan shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development or such longer time as may be agreed in writing with the Local Planning Authority. The provisions of the Travel Plan shall be implemented and operated in accordance with the timetable contained therein and shall not be varied other than through agreement with the Local Planning Authority.

8 Notwithstanding the details on Plan 307B further details of the wall at the front of the proposed building showing a reduction in its height is to be submitted to and agreed in writing by the Local Planning Authority. The approved details shall be retained as such thereafter.

9 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, Schedule 2, Part 2, Class A, (or any subsequent re-enactment), no gates, fences, walls or other means of enclosure shall be erected or constructed forward of any wall of the dwelling(s) which fronts on a highway without the express consent of the Local Planning Authority.

2 All planting shall be maintained any any trees or plants which within a period of 5 years from the date of planting, are removed, die or become seriously damaged or diseased shall be replaced in the next planing season with others of a similar size and species unless otherwise agreed in writing by the Local Planning Authority.

3 Notwithstanding the details on the proposed plan Job No. 1114C/020 no development shall commence until further elevations of the lighting columns and their exact location within the site be submitted to and approved in writing by the Local Planning Authority. 1 The development to which this permission relates must be begun not later than the expiration of three years from the date of this permission.

2 No development shall take place until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. Development shall be carried out in accordance with the approved details.

3 Visibility splays shall be provided at the junction of the access(es) to the highway in accordance with details to be submitted to and agreed in writing with the Local Planning Authority, and any such access shall be generally formed and hard-surfaced before any other part of the development is commenced or brought into use.

4 The erection of fencing for the protection of trees shall be undertaken before any equipment, machinery or materials are brought onto the site for the purposes of the development, and shall be maintained until all equipment, machinery and surplus materials have been removed from the site. The above mentioned fencing shall consist of 1.5metre high chestnut paling fence (or other approved fence) erected at the full extent of each tree. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavations be made without the written permission of the Local Planning Authority.

5 No development shall be commenced until a scheme for the provision and implementation of a surface water regulation system has been approved by the Local Planning Authority. The scheme shall be completed in accordance with the approved plans before any of the housing is occupied.

6 Prior to the commencement of development, a detailed survey of all bat roosts within the building shall be carried out by a suitably qualified ecologist and shall be submitted to and approved by the Local Planning Authority.

7 The development will detrimentally affect Policy HS4 (Criteria for New Housing Development) and has been allowed because of exceptional circumstances. In order to ensure that the Policy HS4 (Criteria for New Housing Development) are conserved, it is necessary for adequate provision to be made to secure the recreation of the habitan outside the development area.

8 No development shall take place until full details of the finished floor level(s) and the surrounding ground levels in comparison with existing ground levels within and adjoining the site, have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the agreed levels.

The Local Planning Authority considers that the proposed development would result in an over-intensification of an existing use and, by reason of noise and general disturbance associated with the increased scale of activities, would be detrimental to the amenities which the occupiers of premises within the vicinity of the site could reasonably expect to enjoy and would be contrary to policy SH1 (Criteria for Development in Key Town Centres) of the Wirral Unitary Development Plan and SPD - Hot Food Takeaways, Restaurants, Cafes and Drinking Establishments.

The Director of Technical Services submitted a report advising the Committee of the erection of an unauthorised fire escape at 6 Magazine Lane, New Brighton. He recommended that enforcement action should be taken to remove the unauthorised fire escape.

Resolved - That the Acting Monitoring Officer and Proper Officer take enforcement action under Section 172 of the Town and Country Planning Act 1990 requiring the rear fire escape to be permanently removed within one month from the date of the notice taking effect.
