Minute 8 - DRAFT STATEMENT OF PRINCIPLES UNDER THE GAMBLING ACT 2005

The Director of Regeneration reported that under the Gambling Act 2005, which was due to come into effect from 1 September 2007, Wirral Borough Council would become the Licensing Authority responsible for granting premises licenses in the Borough of Wirral in respect of betting premises, including tracks, bingo premises, family entertainment centres, adult gaming centres, and casino premises. It would also have responsibility for certain gaming machine permits, temporary use notices and occasional use notices, as well as the registration of small society lotteries.

The Gambling Act 2005 required the Council to prepare and publish, by 3 January 2007, a Statement of Licensing Principles that the Authority would apply when considering applications under the Act. He presented a draft document, and commented that should anything in the statutory regulations, codes of practice or guidance impact on the document, appropriate amendments would be made prior to publication. He outlined the results of a consultation exercise that had been undertaken, and indicated that the document would be presented to the Council for approval on 18 December 2006.


Minute Decision :

Resolved -

(1) That the Draft Statement of Licensing Principles be approved as a Draft to be considered by the Council on 18 December 2006 for approval as the Statement of Principles to be applied under The Gambling Act 2005.

(2) That should amendments to the draft document become necessary as a result of the publication of statutory regulations, codes of practice or guidance, a further report be presented to a provisional meeting of this Committee to be held on 13 December 2006.

Minute 9 - CUMULATIVE IMPACT OF LICENSED PREMISES


Minute Text :

A member requested that consideration be given to the development of a cumulative impact policy for areas where evidence shows that there is cumulative impact on the promotion of the Licensing Objectives, arising from the concentration of licensed premises in the area.

The Head of Regulation commented that such a policy could be considered when the current Licensing Policy was reviewed.


Minute Decision :

Resolved - That further consideration be given to the the development of a cumulative impact policy together with the review of the Statement of Licensing Policy in 2007.
