Resolved - That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A to that Act.

The Sub-Committee convened to consider the appeal by an employee in the Housing and Environmental Protection Department against the decision of the Director of Housing and Environmental Protection to dismiss him for gross misconduct. The appellant was represented by Mr W Gill, of UCATT.
  Minute Decision :
Resolved -

(1) That this Appeals Sub-Committee is satisfied on a balance of probabilities that the appellant had committed a criminal act by physically assaulting his manager without provocation at a work related function.

(2) That the Appeals Sub-Committee therefore supports the Director’s decision to dismiss the appellant on the grounds of gross misconduct and disallows his appeal.
