Resolved - That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A to that Act.

Minute 12 - DISCIPLINARY APPEAL

The Sub-Committee convened to consider the appeal by an employee in the Corporate Services Department against the disciplinary action which the Director of Corporate Services had taken against the employee. The appellant was represented by Mr K Birch of UNISON.
  Minute Decision :
Resolved - That, on hearing the evidence, the Appeals Sub-Committee reached the following conclusions:

(1) That in respect of the first allegation no warning be issued.

(2) That in respect of the second allegation an oral warning be issued.

(3) That in respect of the third allegation the appellant should receive a final written warning to the effect that any further act of misconduct would make the appellant liable to dismissal. In view, however, of the mitigating circumstances and the appellant's previous unblemished disciplinary record, this final written warning should only remain on the appellant's record for 12 months.

(4) That the Director's decision to terminate the appellant's employment (within 12 week's of receipt of the notification of this decision) in the appellant's current post be upheld.

(5) That the Director's offer of alternative employment within the Corporate Services Department be confirmed and remain open up until the date of notice of termination expires.

(6) The Sub-Committee fully recognises the appellant's history of distinguished service to the Council.
