Members of the Panel were asked to declare any disclosable pecuniary and non pecuniary interests in connection with any application on the agenda and state the nature of the interest.

 

No such declarations were made.

PRIVATE HIRE VEHICLE LICENCE APPLICATION - FORD FOCUS, REGISTRATION NUMBER MK07 AZP pdf icon PDF 90 KB

Minutes:

The Managing Director for Delivery reported upon an application received to re-licence a Ford Focus, registration number MK07 AZP, beyond the normal over-age date for a licensed private hire vehicle. The vehicle had been licensed as a private hire vehicle since 7 March 2011 and the current licence was due to expire on 6 September 2017, however it had been extended to the date of this meeting. The vehicle had been examined at one of the Council’s authorised testing stations and the pass certificate was available for Members.

 

The owner of the vehicle was present at the meeting with his vehicle which members of the Panel inspected.

 

Resolved – That the application to re-licence the Ford Focus, registration number MK07 AZP be granted for a further six months.

EXEMPT INFORMATION - EXCLUSION OF THE PRESS AND PUBLIC

The following items contain exempt information.

 

RECOMMENDATION:  That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information as defined by the relevant paragraphs of Part I of Schedule 12A (as amended) to that Act. The Public Interest test has been applied and favours exclusion.

 

Minutes:

Resolved - That, under section 100 (A) (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information as defined by paragraph 1 of Part I of Schedule 12A (as amended) to that Act.  The Public Interest Test had been applied and favoured exclusion.

PRIVATE HIRE OPERATOR - COMPLAINTS (NC)

Minutes:

The Managing Director for Delivery submitted a report for Members to consider whether Mr NC should be allowed to continue to hold his Private Hire Operator Licence and his Private Hire Driver Licence.

 

Mr NC attended the meeting and made representations in respect of the complaints made against him.  Members considered the number of complaints made and the explanations given by Mr NC.

 

In determining this matter Members had regard to Sections 61 and 62 of the Local Government Miscellaneous Provisions Act 1976.

 

In coming to their determination the Panel applied the principle of proportionality enshrined within the Human Rights Act 1998. In doing so, Members felt that the protection and safety of the public was of paramount concern.

 

Resolved - That Mr NC’s Private Hire Operator Licence and his Private Hire Driver Licence be revoked.

HACKNEY CARRIAGE DRIVER - COMPLAINTS (AW)

Minutes:

The Managing Director for Delivery submitted a report for Members to consider whether Mr AW should be allowed to continue to hold his Hackney Carriage Driver Licence.

 

Mr AW attended the meeting and made representations in respect of the complaints made against him. 

 

Members gave due consideration to Mr AW’s representations, deliberated at length and exercised their rights to consider each case on its individual merits.

 

Resolved

 

(1)  That Mr AW be allowed to continue to hold his Hackney Carriage Driver Licence.

 

(2)  That Mr AW be issued with a written warning as to his future conduct.

 

(3)  That Mr AW must successfully complete a Driver Awareness Course by 20 October 2017.

40.

The Managing Director for Delivery submitted a report for Members to consider whether Mr MW should be allowed to continue to hold his Private Hire Driver Licence.

 

Mr MW attended the meeting and made representations in respect of the complaints made against him. 

 

Members gave due consideration to Mr MW’s representations, deliberated at length and exercised their rights to consider each case on its individual merits.

 

Resolved

 

(1)  That Mr MW be allowed to continue to hold his Private Hire Driver Licence.

 

(2)  That Mr MW be issued with a written warning as to his future conduct.
