The Managing Director for Delivery reported upon an objection notice that had been received from Environmental Health in respect of a temporary event notice for Club LQD, 92 Argyle Street, Birkenhead under the provisions of the Licensing Act 2003.

 

The Managing Director for Delivery advised that the Sub-Committee are asked to consider the Objection Notice received from Environmental Health; to determine whether a counter notice should be issued by the Licensing Authority.

 

Members were informed that the premises currently hold a Premises Licence allowing the licensable activities as set out within the report.

 

Members were informed that the purpose of the temporary event notice was to extend the open hours and sale of alcohol on Sunday 27 August 2017 and Monday 28 August 2017 from 04.00 to 06.00 over the 2 days of the Bank Holiday weekend.

 

The Premises Licence Holder Crystal Kelly and the Proprietor Greg Rogers attended the meeting.

 

Mr Rogers addressed the Members to explain why they were proposing to extend the hours from 04.00 to 06.00 and responded to questions from Members of the Sub-Committee and Mr A Bayatti, Legal Advisor to the Sub-Committee.

 

The Environmental Health Officer Mr Zorn addressed the Members and explained they had received a complaint from a local resident on 5June 2017 about the continual loud music being heard 7 nights a week and that on 10 August 2017 a further letter of complaint was received that the noise was louder than previously complained about.

 

The Environmental Health explained that they had concerns due to the close proximity to the local resident's property to the premises in regards to the extended opening hours for the Sunday and Monday nights/ early hours of the morning for the loud music to continue till 06.00 would cause a nuisance.

 

Mr Zorn responded to questions from Members of the Sub-Committee, Mr A Bayatti, Legal Advisor to the Sub-Committee and the Proprietor.

 

In determining the matter, Members of the Sub-Committee gave consideration to the objection notice given by the Environmental Health Officer; and the submissions made by Mr Rogers.

 

 

Resolved

 

(1)  That in accordance with Regulation 14(2) of the Licensing Act 2003, the public be excluded from the meeting during consideration of the application.

 

(2)  That a Counter Notice be issued under Section 105(2)b of the Licensing Act 2003, resulting in the premises not being licensed between the hours of 4.00 am and 6.00 am on Sunday 27 August 2017 and Monday 28 August 2017.
