On a motion by Councillor Johnston, seconded by Councillor Mooney, it was –

Resolved – That Councillor G Ellis take the Chair for this meeting.

The public may be excluded from the meeting during consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information.

RECOMMENDED – That in accordance with section 100A (4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the following item of business, on the grounds that it involves the likely disclosure of exempt information as defined by the relevant paragraphs of Part 1 of Schedule 12A (as amended) to that Act. The public interest test has been applied and favours exclusion.

To determine the dismissal appeal of a member of the Finance Department.

The Sub-Committee convened to consider the appeal by an employee in the Finance Department against the decision of the Director of Finance to dismiss him from his current post.

Resolved - That, having considered carefully all the evidence, the Appeals Sub-Committee upholds the appeal and,

(i) the appellant be reinstated in his post with arrears of pay but subject to a final written warning as an alternative to dismissal in terms that if he commits any further act of misconduct or indiscipline he is likely to be dismissed;

(ii) the final written warning shall remain in force without a time limit.
